Expert Determination
Unlike arbitration and adjudication, expert determination is a form of ADR where an independent expert, who has entered into a contractual arrangement with the relevant parties, determines a dispute, which may or may not be legally binding, based on agreed rules and procedures. The agreement to resolve disputes using expert determination emanates from either the parties’ construction or engineering contract, or by subsequent agreement where no such contractual provisions have been agreed.
