Adjudication

Introduced to the construction industry via legislation in the UK in 1999, adjudication is a fast-track statutory form of alternative dispute resolution (ADR) intended to ensure disputes under construction and engineering contracts are determined by an independent adjudicator within strict timeframes.

Equivalent legislation has subsequently been enacted within several common law jurisdictions, including every State and Territory of Australia. Its popularity has led to parties to a construction or engineering contract utilising adjudication as the preferred means of ADR, compared to arbitration and litigation.

PIER Consulting’s Director, Richard Inman, initially qualified as an adjudicator under the UK legislation after successfully completing the Chartered Institute of Arbitrator’s (CIArb) Pathway to Fellowship programme in London.

Richard subsequently qualified as an adjudicator in various Australian jurisdictions and he is currently:

A grade 2 adjudicator with the Queensland Building and Construction Commission (QBCC)

On the Royal Institution of Chartered Surveyors (RICS) panel of accredited adjudicators in New South Wales, Victoria and Tasmania

An accredited adjudicator in Northern Territory

PIER Consulting also advises and supports parties in respective of their rights and obligations under every Australian Security of Payment legislation.
